Definitions
For the purposes of these terms and conditions, unless the context otherwise requires or unless otherwise expressly defined herein:
“We”, “us”, “our”, or “the Company” shall mean Thermomix® Brunei | Truemix (B) Sdn. Bhd.;
“You” shall mean our customers, clients and potential customers and clients;
“Territory” shall mean the legal territory of Brunei Darussalam.
Territorial Sales and Jurisdiction
We only sell and ship the Thermomix® within the territory. We reserve the right to fulfil or reject orders outside the territory made through our online store for other products such as but not limited to cookbooks and Thermomix® accessories.
Notwithstanding the country of origin for an order of our products and the occurrence of the effective date of purchase, in the event of a dispute arising out of or in connection with these or any of our other terms and conditions, you agree that the place of jurisdiction is Brunei and in the interpretation of this agreement, the laws of Brunei shall apply.
Pricing
Unless otherwise indicated, all product prices displayed are in Brunei Dollars (BND). The displayed prices include freight and handling charges, where applicable, and these will be added to the total price of your orders.
Product prices are subject to change without prior notice.
Product descriptions
While we take reasonable measures and precautions to ensure the accuracy of information we publish on our online shop, we cannot guarantee that it will always be correct.
Our online shop includes images for illustrative purposes, but we cannot promise that any image will always reflect or portray the full design or options relating to that product.
You may verify any information by contacting us or your Advisor prior to making any purchase.
Warranty
We provide warranty for our products. Please refer to our Warranty Terms and Conditions.
Placing your order
You must be at least 18 years of age to place an order on our online shop.
User Registration
Registration is not required prior to making an order through our online shop (“Club Thermomix®” or “Club”). However, when making your first order, all the information that you provide (such as name, delivery address, email, and phone number) will be used to register yourself to the Club. Please ensure that your details are correct to avoid any inconvenience such as wrong delivery of your orders.
Registration is only complete when you have supplied the required information and we have confirmed your login information with you.
All information supplied by you upon registration must be true, complete, and accurate (“User Data”). You must maintain and promptly update your User Data as appropriate from time to time.
We reserve the right to refuse any user registration, deny access, or terminate an existing registration if all or part of the information you have provided is false or inaccurate. Other grounds for refusal of registration, denial of access, or termination of registration may include, but are not limited to, offensive content, obscenity, defamatory content, contempt, incitement, copyright infringement, brand names or registered trademarks, company or organisation names, names of high-profile or public figures or names promoting political, religious, social or economic groups or issues.
Without limiting any other provision of these terms, if you provide any information that is untrue, inaccurate, incomplete, or if we have reasonable grounds to suspect that such is the case, we reserve the right to suspend or terminate your user account and to refuse any and all current or future use of Club Thermomix® (or any portion thereof).
You agree not to assign, transfer or sublicense your rights as a Registered User of Club Thermomix®. You further agree not to register more than one account, create an account on behalf of someone else, or create a false or misleading identity.
You agree to keep the User Data confidential. You understand and agree that you are fully responsible for all actions and submissions made from your account. If you become aware of any unauthorised use of your account, you should notify us immediately.
Payment method and processing
Our preferred payment methods are online banking and credit/debit cards at our headquarters. We may also offer other methods of payment for online purchases and these methods will be presented to you upon checkout of the product you purchased from us. However, all payment methods are subject to availability.
We will process your payment immediately. However, all payments are subject to the final approval of your bank.
Until all amounts due and owed by you to us have been paid in full, you authorize us to charge your chosen payment method (including but not limited to credit card and debit card). You agree to keep your payment information current at all times.
You further agree that, where applicable, the credit/debit card that you have provided is valid and has the sufficient amount or has the sufficient credit limit for payment of your purchase. If the card or your payment method cannot be verified, is invalid, is over-limit or is not otherwise acceptable, your order may be cancelled or suspended by us.
By making a purchase, you agree to pay the full amount of the product prices and the payment terms as indicated in Club Thermomix®. You further agree that the Company reserves the right to seek recovery of any monies remaining unpaid by you regardless of the payment method.
The Company is not liable for any false or misleading information provided by you.
Full Payment via Credit Cards
Thermomix® Brunei | Truemix (B) Sdn. Bhd., extends various payment options. For credit card payments, you may apply for instalment plans directly from your banks, if available and where applicable. The payment calculations may be explained by your Thermomix® Advisor.
Security of Information
While we use our best efforts to protect the security of transmission of information over the internet, we do not guarantee or warrant that any transmission of any data over the internet is completely secure. Accordingly, any information which you transmit to us is transmitted at your own risk. However, we take reasonable steps to preserve the security of any information that you have provided to us.
Your Privacy
We may collect information from third parties (such as Independent Thermomix® Advisors). If you choose to purchase our products and/or avail of our services, or if you choose to become an Advisor, you will be required to provide personal information to us. By providing information, you agree that we may use the information to directly market to you (unless you opt out). Information may be disclosed to recipients in Brunei for marketing or other legal purposes.
We collect, hold, and use information subject to our privacy policy.
Cancellation Policy
All transactions may be cancelled before making any payments. Once the payment has been made, the Return and Refund Policy shall apply. Please read and understand all the terms and conditions before finalizing your purchase.
The Company reserves the right to hold or cancel any order before or after payment has been made with notice given to the customer at a reasonable time when deemed necessary in any of (but not limited to) the circumstances listed below:
- the item ordered is not available; or
- payment failed or was not received; or
- payment information could not be verified; or
- any other unforeseen circumstances beyond the control of the Company not listed above.
Delivery
We do not provide any delivery services. Customers and/or their authorised Advisors are allowed to collect any orders. We reserve the right to refuse collection of any order if we are unable to verify the identity of the person who wishes to do any collection.
Return and Refund Policy
In general, there is no return and refund of any purchase. If there are any valid reasons such as purchase by mistake or due to misinformation, the customer may return any Thermomix® product within seven (7) working days from the date of purchase provided that the products or goods must be sealed and unopened, with packaging in its original condition, accompanied by a valid receipt or proof of valid purchase, and in good sellable condition. However, if the packaging has been opened, the Company reserves the right to deny any return or refund regardless of whether it was already used or not.
Returns and refunds will be considered on a case-by-case basis and are subject to the Company’s inspection of the returned item and verification that it is in perfect condition.
In the case of verified refunds, the refund will be processed subject to the Customer’s bank used for payment. The Company shall refund the amount paid for the Products less shipping, handling, and other miscellaneous charges, where applicable.
Items purchased as part of a set or a multi-item pack must be returned as a whole set, including free items. We reserve the right to reject any request for a return if the whole set is not returned.
All terms and conditions herein are subject to applicable laws of the territory.
Violations of these terms and conditions
Without limiting any other remedies available to us at law or in equity, we reserve the right to temporarily or indefinitely refuse to provide services to you without notice if:
- you breach any provision of these Terms and Conditions;
- we are unable to verify or authenticate any information that you provide to us; or
- we believe that your actions may cause damage and/or legal liability, to us, any of our customers or suppliers or any other person.
General
We reserve the right to amend these terms and conditions at our sole discretion and as we deem fit and reasonable without prior notice.
If any of these terms are found to be void, unlawful, or unenforceable then that part will be deemed to be severable from the balance of the terms and the severed part will not affect the validity and enforceability of any remaining provisions.
These terms will be governed by and interpreted in accordance with the laws of the territory.
You agree to the jurisdiction of the courts and other alternative means of dispute resolution of the territory to determine any dispute arising out of these terms.
Thermomix® Warranty
Thermomix® provides a limited warranty (this “Warranty”) to the end-user purchaser (“you”) of the Thermomix® against manufacturing defects provided that they are used in accordance with the Thermomix® user manual and subject to the terms herein.
This Warranty applies only to purchases made in Brunei and only covers genuine Vorwerk-branded products. This Warranty is only valid in and subject to the laws of Brunei.
If a defect is discovered at the time of delivery, please do not use the item. Keep it in its original packaging and contact your local service centre or your Thermomix® Advisor immediately. Once your Warranty claim is received by Thermomix® Brunei | Truemix (B) Sdn. Bhd. (the “Company”, “us”, “we”, “our”), the cause of the problem will be investigated, and if the fault with the Product is a consequence of the Manufacturer’s defect in materials or workmanship, the Company will, at its option, repair, replace, or refund the Product, where applicable. “Manufacturer’s defect” is explained below.
The Company reserves the right to amend or modify the terms and conditions of this Warranty without prior notice.
Warranty Period
Warranty for the Thermomix® and spare parts supplied with it, are for a period of 24 months from the date of dispatch from the Company. Within this period, we will repair or replace, at our option, defective parts at no charge (under Warranty).
The warranty covers faulty parts or manufacturing defects as defined below. The warranty excludes normal wear and tear on blades and other consumable parts that are available in our online store for wear and tear replacement.
This Warranty only applies if the Thermomix® is used and cared for in accordance with the guidelines set out in the manufacturer’s instruction manual provided at the time of purchase.
Consumables, such as the Varoma, simmering basket, spatula, measuring cup, Butterfly Whisk, mixing knife, cover plate, mixing bowl, and splash guard are not covered under the manufacturing warranty.
For other spare parts and accessories, the warranty depends on the type and/or model of such spare part or accessory.
Repairs and Modifications
This Warranty is not valid if repairs had previously been undertaken by anyone other than an authorised Thermomix® Brunei | Truemix (B) Sdn. Bhd. service technician (“Service Technician”) or if the fault has been caused by misuse, negligence or alterations to the Thermomix® by anyone other than a Service Technician.
Reimbursement
The Company, to the extent permitted by local law, may seek reimbursement from you of any reasonable costs incurred by them if the Products are found to be in good working order or where the problem falls under any of the warranty exclusions and limitations. Reasonable costs may include transportation costs and parts, and labour costs.
What is covered by the Warranty?
Thermomix® warrants the product(s) in the original sales package against manufacturing defects as defined below, when used in accordance with Thermomix® user manual for the duration of the Warranty Period.
Manufacturing Defects
Manufacturing defects are substantial defects that include but are not limited to defective parts generally inaccessible by consumer.
What is NOT covered by the Warranty?
Non-manufacturing defects are not covered by the warranty. All consumables and/or accessories (such as the Varoma, mixing knife, cover plate, mixing bowl, spatula, Butterfly Whisk, simmering basket, splash guard, blade cover, etc) are generally non-serviceable items that go through wear and tear from regular usage and are not covered by the warranty. These items are also available as replacement part purchase from our online shop. General wear & tear and/or mishandling are considered non-manufacturing defect(s) as defined below.
Non-Manufacturing Defects
Non-Manufacturing Defects are defects that include, but are not limited to, the following:
- Defects detected after usage
- Defects on parts that are accessible by consumers
- Defects on consumable parts that may be purchased & replaced by consumers
- Anything caused by general wear and tear
- Defects due to mishandling (such as filling the mixing bowl past the max limit) and accidents (including voltage surge)
- Defects due to using the Thermomix® not for its intended use
- Non-serviceable/consumables
Warranty Support
The instruction manual provides basic solutions for common malfunctions. Please consult your manual first should a minor malfunction occur. In all other situations, in the first instance, please contact your independent Thermomix® Advisor or send an email to enquiry@thermomix.com.bn.
Warranty Disclaimer
Under no circumstances shall the Company be liable for any loss, direct, indirect, incidental, foreseen, unforeseen, special or consequential damage arising out of or in connection with the use of the products.
The company makes no other express warranty or condition whether written or oral and, only to the extent permitted by law, the company expressly disclaims all warranties and conditions not stated in this warranty. To the extent that the above warranty services and terms or any part thereof is inconsistent with Malaysian laws, the warranty services and terms or the corresponding part shall be deemed modified to be consistent with such law. Except to the extent lawfully permitted, this warranty does not exclude, restrict, or modify but are in addition to the mandatory statutory consumer rights applicable to the sale of the Thermomix® product to you.
Definitions
For the purposes of these terms and conditions, unless the context otherwise requires or unless otherwise expressly defined herein:
“We”, “us”, or “the Company” shall mean Thermomix® Brunei | Truemix (B) Sdn. Bhd.;
“You” means our customers or participants of our events;
“Terms” means these terms and conditions;
“Participant” means you, or any of our participants of our events;
“Territory” means the legal territory of Brunei;
“Cooking Class” means cooking classes held by us including Virtual/Studio/Hands on Cooking Classes, and Demonstration and Seminar Cooking Classes;
“Event” or “Events” mean the events held by us at various locations;
“Event Sponsor” means a third-party sponsor of the Event;
“Your Materials” means all materials submitted or presented by you including, but not limited to, your name and biographical information, in electronic copy or hard copy, verbally, or otherwise.
Agreement
These terms and conditions govern your registration for and participation at any of our Events, and are an agreement between Thermomix® Brunei | Truemix (B) Sdn. Bhd. and you.
By booking or registering for our Events, you acknowledge that you have read and accepted these Terms. You may only book or register for and attend the Event in accordance with these Terms.
Unless the Event description specifies otherwise or we expressly inform you otherwise, you must be at least 18 years of age on the first day of the Event. Events are subject to availability.
Age restrictions for attendance
Due to occupational health and safety factors, our Studio/Hands on Cooking Classes are only suitable for Participants aged 18 years and over unless otherwise stated in the Event description of the said event.
Our Demonstration and Seminar Cooking Classes are suitable for all ages. However, children under the age of 12 years must be accompanied by an adult.
Acceptance of risk
As a participant in one of our Cooking Classes, you understand and accept the inherent risks in the preparation and cooking of food at a Cooking Class.
By attending a Cooking Class, you agree, to the extent permitted by law, to release, indemnify and hold harmless Thermomix® Brunei | Truemix (B) Sdn. Bhd., and its officers, employees, agents, Advisors, licensors, partners and affiliates from liability for any or all damage, loss, costs, expenses, harm and/or injury that may result from, or occur in connection with:
- Your use of or connection to this site;
- Your attendance and/or participation at a Cooking Class or Event;
- Any material or information that you submit, post, transmit or otherwise make available through this site; and
- Your negligence or misconduct, breach of these Terms or violation of any law or the rights of any person.
Prices
Unless otherwise expressly stated, all amounts payable through our online store are in Brunei Dollar
We reserve the right to change the prices for goods and services in our online store at any time before you place an order.
This clause does not limit your rights as a consumer under any relevant Brunei law.
Orders and confirmation of booking
Order constitutes offer
By placing an order for an event through the online store, you make an irrevocable offer to us to purchase the services that you have selected pursuant to these Terms. Information contained in this site constitutes an invitation to treat only. No information in this site constitutes an offer by us to supply any services to you – however, we will endeavour to supply your selected services to you.
We will not commence processing any order made through the online store unless and until payment for the order has been received by us in full, and the order has passed our internal validation procedures, which are undertaken in order to verify the bona fides of each order for the purpose of preventing credit card and other fraud.
We reserve the right at our discretion to at any time prior to your order being accepted in accordance with these Terms, cancel all or part of your order, and at any time refuse to provide services to you, terminate your access to this site, and/or remove or edit any content on this site.
Confirmation of Booking
We will notify you of the acceptance of your order and confirmation of your booking when we send you a confirmation email. We may opt to notify you by other means apart from an email.
Payment methods and policy
Payment for orders placed through the online store may be made by credit card (Visa & Mastercard) and other payment methods that we offer.
You acknowledge that, to the best of your knowledge and belief, the information provided by you is correct, true, and complete.
Credit card limitations
Please note that we may be unable to accept credit cards issued by banks outside of Brunei in some cases.
Payment Security
While our payment processing and website hosting providers employ secure technology for transactions with our customers, we will not be responsible for any damages, including consequential losses (whether direct or indirect), that may be suffered by a customer whose credit or debit card or bank account information is used in a fraudulent or unauthorised manner by any person other than us.
We may request further information from you, such as a copy of your credit card and/or other identification documentation, as part of our internal validation procedures. These procedures help protect bank and credit card account holders from online fraud. Until your order has passed our internal fraud prevention checks, your order will remain on pending status. If further information is requested and you do not provide the requested information within such time as we consider appropriate at our discretion, your order will be cancelled and, if your payment has been received, it will be refunded back to you.
Your Information and Privacy
Generally, we handle your information in accordance with our Privacy Policy.
We may provide your contact information to Event Sponsors or Co-Organisers if:–
- you elect to attend any sessions or other activities at the Event involving Event Sponsors or Co-Organisers; in which case, you would provide your personal information only to the Event Sponsor or Co-Organiser involved in such session or other activity; or
- you opt in or otherwise to receive communications from our Event Sponsors or Co-Organisers.
By participating in our Events, you agree that we may derive information from recordings of your voice and images of your face and retain and use all resulting information, in each case in accordance with our Privacy Policy.
You grant us, our affiliates, and our independent contractors the right to record, film, photograph, and capture your voice and image in any media at the Event (the “Recordings”). You grant to us and our affiliates, agents, employees, and assigns a non-exclusive, perpetual, worldwide, royalty-free right and license to use, reproduce, modify, distribute, and translate, for any purpose relating to our business, all or any part of the Recordings and Your Materials. We may edit the Recordings and Your Materials, use them alone or together with other information, and we may allow others to use and disseminate them.
Please inform our staff or our independent contractors if you do not consent to having your voice and/or images being recorded prior to or during the Event.
We may impose a fee should you wish to have your voice or image redacted from any of such recordings.
If any of the Terms herein relating to privacy is inconsistent with Malaysian privacy laws, such inconsistency shall be deemed void to the extent of such inconsistency without invalidating the remaining terms and conditions.
Cancellation and Refund Policy
There is no cancellation for booking/registration or refund after you have made a payment for an Event. In the circumstance that we cancel an Event, we shall arrange for a refund for the payment you have made for such cancelled Event.
General terms and conditions
Entry into Cooking Class or Event
Your safety and security are important to us. You understand that you and your property may be subject to a reasonable search upon entry to the Event and you may be asked to provide photo identification. If you refuse to participate in these security measures, we may deny you entry.
To ensure entry into the Cooking Class or Event, please:
- bring the confirmation email to the venue as proof of purchase;
- arrive at least 15 minutes prior to the course commencement time.
Please note that Participants who arrive more than 15 minutes late may be refused entry into the Cooking Class or Event.
Food allergies and dietary requirements
Please make our staff are aware of any food allergies or dietary requirements you have at the Cooking Class or Event so we can advise you about which foods you should not consume.
Dress code
Due to occupational health and safety reasons and the comfort of Participants, it is a requirement that closed flat shoes are worn to Cooking Classes and Events.
Requests to leave
We reserve the right to ask you or any Participant to leave at any time during the Event if your or their behaviour causes us concern for the safety or security of Event attendees. Examples of these behaviours may include but are not limited to intoxication, disruptiveness, being offensive to others, dangerous behaviour, recklessness and/or causing or potentially causing harm to person or property.
Loss and damage
To the extent permitted by law, we are not responsible for the loss or damage of personal items prior to, during or after a Cooking Class or Event.
As a Participant, you may be held financially responsible for any damage to or loss of property caused by you while on the premises.
Variations to these Terms and Conditions
We reserve the right to amend these Terms and any other policy on this site at any time in our sole discretion and any such changes will, unless otherwise noted, be effective immediately.
You may only vary or amend these Terms and Conditions by written agreement with us.
Force Majeure
In the circumstance the Company is unable to organise any Event due to acts of God, strikes, equipment or transmission failure or damage reasonably beyond our control, or other causes reasonably beyond our control, we shall not be liable for damages or any damages resulting from such failure to perform or otherwise from such causes.
Governing law and severability
These Terms are governed by the laws in force in Brunei.
Any part, provision, or representation of these Terms which is prohibited or which is held to be unlawful or illegal shall be ineffective to the extent of such prohibition or illegality without invalidating the remaining provisions hereof.
Any disclaimer set out in these Terms does not attempt or purport to exclude liability arising under statute if, and to the extent, such liability cannot be lawfully excluded.
